Who Ate The Birthday Cake?

It was Lucy!
The evidence is circumstantial but overwhelming nevertheless.
The accused was seen to enter the room where the cake was located.
When I went into the room a few minutes later, the cake was nowhere to be seen.
No-one else had entered the room.
The accused was seen to be jumping down from the table, licking her lips.
When confronted with the accusation, she remained silent but held her head down.
We ask that previous convictions be taken into account when sentencing.
These include eating a Cadbury's Flake Egg resulting in a veterinary consultation fortunately with no side effects and eating bird food on a regular basis.
What should the sentence be?
